of the people are dead or alive. earlier this morning, u.s. plane landed in albeer ya to pick up americans involved in the crisis. the captors are an off shoot of a gas complex. and opening statements will be heard this morning in the misconduct trial of john leopold. this after a big development in the case. what has changed? >> reporter: he died to have a -- he decided to have a judge decide his fate. he left the courthouse yesterday, giving up his right to a jury trial. they would not say why the decision was made. it is after two days of court questioning of more than 300 potential jurors. he is on trial for misconduct charges. he is accused of using his taxpayer funded police detail for personal and political reasons. the state prosecutor alleges that he made them run errands

attack led to the lawsuit ruled that the pit bulls were inherently dangerous. he said the compromise is aimed at protecting dogs instead of people. >> the idea that we're going to return to that is not -- and with concern for dog owners, again, it undermines the whole philosophy of how our victims are getting retribution. >> the ruling led to a lawsuit by owners who aren't their homes and want to keep the dogs. an attorney representing three plaintiff plaintiffs said if the legislation passes. news around the nation for you. another person is thrown on to tracks. this time it was in philadelphia. but she as able to pull herself on to a platform. and video show as man throwing her on to the tracks, grabbing her legs. you see it, tosses her off the bench and then like that. he walks off. grabbed her cell phone. he was later arrested. quick thinking saved a

woman's life after her suv went right into a pool. can you see the car submerged and the person pulled the suv to the edge of the pool probably by the roof rack. investigators say that the driver somehow missed a turn, drove through a fence and went into the pool. she was not hurt. robbers are known for array of disguises, one apparently forgot so decided to improvise. it was caught on camera. he used a bucket stealing from a restaurant. you can see him coming up in the video coming in. lifting up the lid so he can see what he is doing. watch. that's where we're supposed to. do he tried to break into a pawn shop. he didn't have any luck there. and it didn't work out. police ided the guy that you just saw and arrested him. this weekend will be going to the birds. >> it is. and before getting ready for
